Contract & Policies
Below is a typical contract.

Welcome to the select few who have the joy of owning one of the world’s most lovable creatures. We at Free Range we treat our cats and kittens like family, and hope you do the same. Our contract covers just about every concern that pertains to the cat/kitten, answering many questions before they are even asked.  This is a sample contract below.

The Seller and Buyer agree to the following:

The kitten will be in excellent health at the time of sale and has had the following vaccinations and/or tests:  

~ Feline vaccinations against rhinotracheitis, calicivirus, feline distemper (panleukopenia).  
~ Two sets of routine deworming, a practice every kitten should have while in infancy.

~ Spay or neutered prior to heading home.

Free Range requires a $400* deposit per kitten/cat, which is non-refundable to reserve kitten/cat. (*If putting a deposit down for a future litter, the deposit remains refundable until it is applied to a specific kitten.)  This deposit will go towards the total agreed upon price. Payments are to be made in the form of PayPal, Venmo or Cash. Personal checks are NOT accepted. We cannot hold a kitten without a deposit.  The balance of the adoption fees are not due until the kitten is in your hands.

Final payments (not including the deposit) made using PayPal and Venmo will include 25% processing fee. To avoid any additional fees, cash is accepted. Receipt of payment will be provided to the Buyer. PayPal to Angela@sphynx.net. Venmo is Angela-Orton-1. The kitten must be paid for in its entirety before it is released to your possession.

Kitten can be picked up (no cost), delivered to a half-way point depending on location (usually minimal fee for gas and time), or personally flown to the nearest airport. Buyer is responsible for deliver fees incurred in getting your kitten to you.  Seller will try to secure the most economical mode of transportation that is safe for the kitten. Buyer may use their own airline miles if they want to minimize delivery fees.

Cat/kitten will be kept as a loved member of the family and will receive frequent and kind human attention. Cat/kitten will not be caged as a primary living arrangement, i.e. other than for transportation or illness. The kitten will be given the proper diet in the proper amount, and will have fresh water and clean litter boxes available at all times.

This cat or kitten is to be of sound health upon arrival, and will not be receiving medication or supervision by a veterinarian without full disclosure to the Buyer. The cat/kitten must be established as a new patient and evaluated by a veterinarian within three days of custody. If Buyer chooses not to take the cat/kitten to a veterinarian within the three day window of custody, all health guarantees are null and void. For the entire 25 years of breeding, we have never had a kitten die or fall ill right after adoption, or while the kitten was in its infancy.

Seller is not responsible for any vet bills incurred once kitten/cat is in the Buyer’s possession. The Seller will not be held accountable for diagnosis of any acquired illnesses or infections, due to the fact that these can be contracted anywhere in the environment, and are not a result of genetics or breeding. The kitten/cat is guaranteed against fatal congenital defects up until it’s one year old.  Should it die within this time from a congenital defect the kitten/cat will be replaced by one of the same quality and value when next available, only if a necropsy has been preformed and a certificate from your vet is provided as proof of the cause of death.  Necropsy and related fees are responsibility of the Buyer. No veterinary services will be reimbursed and will always be the responsibility of the buyer.

If for reasons other than the animal’s health you cannot retain ownership of the cat/kitten, the Seller will be given the right of first refusal as a surrender.  No kitten/cat from this cattery may be sold/given privately, given to an animal shelter, sold or given to a pet store, abandoned, or sold or given to a laboratory for experimental purposes. This kitten/cat is not to be destroyed for any reason other than terminal illness or injuries approved by a veterinarian.

The kitten/cat will not be de-clawed Initial_____________. De-clawing is an inhumane mutilation. Weekly nail-clippings, gentle discipline with a squirt bottle, along with the availability of a scratching post or mat will nearly eliminate scratching problems. Soft Claws are an easy solution and a beneficial training aide.

It is understood that degrees in hairlessness in Sphynx, Elf, Dwelf and Bambinos vary from cat to cat and that no feline is completely hairless. Fur on the tail, feet and face, back of ears is common.  Furthermore, it is understood that hormones and genetics play an important role in hairlessness and that even though a kitten may be almost hairless when adopted it is possible the kitten could develop some hair after being neutered/spayed or as it grow older. Reasons include but not limited to weather, climate, seasonal and hormonal changes, all which can have a bearing on hair growth.  It is not guaranteed that your cat will remain silky smooth.

If the Buyer having put a deposit on a kitten/cat should later change their mind about the purchase, the deposit will not be refunded. If, however, the kitten/cat should perish before the buyer picks up his/her kitten/cat, Free Range will give the Buyer the option of a refund or apply the deposit to another available kitten.

Kittens typically go home between 12 - 16 weeks. Seller will notify Buyer as soon as they have an exact date, usually when the kitten is not less than 10 weeks old. Once the Seller notifies the Buyer in writing that the cat/kitten is ready to go home, Buyer has 30 days to take possession/delivery. If the Buyer does not communicate with the Seller, or will not take custody within that 30 day period, the adoption is null and void, and Seller will forfeit the cat/kitten and the deposit paid.

Buyer agrees that the cat/kitten will be spayed or neutered prior to placement. The Seller will rarely adopt intact cats to selective breeders that have a like-minded breeding program. If this cat or kitten is adopted as a breeder male, Buyer agrees not to resell this cat or kitten for stud service to anyone unless approved by the Seller. If this cat/kitten is adopted as a breeder female, Buyer agrees not to resell this cat or kitten for use as a breeder to anyone unless approved by the Seller. Seller makes no guarantees as to the fertility or performance of cats or kittens when adopted for breeding. If this cat/kitten is adopted as a breeder, Buyer agrees to use good judgment in breeding, and will always breed for healthy, quality kittens of good temperament, that are a good representation of the breed. When a deposit is placed on a kitten, Buyer agrees that all kittens will be spayed or neutered before they head home. There are no monetary refunds. This policy is not time limited, but remains in effect for the life of said kitten/cat.

Breach of Contract

In the event the Buyer is found to have violated any of the terms and conditions of this contract, the cat/kitten is to be surrendered unconditionally to the Seller.  Seller may reclaim physical and legal ownership of cat/kitten with or without due process of law for any breach of contract with no refund of purchase price and/or transportation of said cat.

This document is a legal and binding contract. This contract is to be governed by the laws of the State of Idaho.  Seller and Buyer signatures indicate full agreement and approval of all the above terms and conditions of this contract. There are no other conditions or guarantees, verbal or implied.  No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined above.  

Any legal action which may arise under the terms of this contract will be brought in Canyon County, Idaho, USA. PURCHASER/BUYER shall be liable for any court costs and related charges including attorney’s fees associated with SELLER enforcing the terms of this contract. In signing this document, BUYER acknowledges that he/she has read, fully understands, and agrees to ALL of the terms and conditions stated above. The laws of the State of Idaho shall be controlling.

* Deposits that are make for upcoming litters are fully refundable until they are applied to a specific kitten. Once you have applied the deposit on a specific kitten, it is taken off market. At that point, the deposit becomes non-refundable.
